Abstrakt

This article explores the interplay between adoption and the European Convention on Human Rights, analyzing the evolving standards established by the European Court of Human Rights. While the right to adopt is not explicitly guaranteed under the Convention, the Court has developed a growing body of case law addressing adoption-related issues through the lens of Article 8 (right to private and family life). The study critically examines the ECtHR's approach to the margin of appreciation doctrine and the subsidiarity principle. The authors argue that while the ECHR provides an effective framework for adoption-related rights, the ECtHR must ensure consistency in its jurisprudence to maintain its legitimacy and influence in shaping contemporary European societies.
